Costa Rica has granted a special migratory status to 85 migrants who were deported from the United States in February under the Trump administration, according to Omar Badilla, the country’s immigration director, who announced it on Wednesday.
Earlier this year, President Rodrigo Chรกvez’s government agreed with the Trump administration to receive up to 200 migrants from Africa, Asia, and Europe, with the initial intention to repatriate them within weeks.
However, Costa Rican authorities confirmed that not all migrants accepted repatriation. In response, the government issued a resolution on Monday establishing a special migratory category valid for 90 days, with an option to extend.
“These people have freedom of movement anywhere within the country… the point of this resolution is not to force anybody to return to their country of origin,” Badilla stated in a video shared with the press.
Since February, the migrants had been housed in a shelter near the Panamanian border with restrictions on movement and no access to their passports. Immigration authorities confirmed to Reuters that repatriation was the most accepted option.
The 85 remaining migrants represent 14 different nationalities and include 31 minors. Under the new resolution, all will now be able to recover their passports, according to Badilla.
The resolution aims to defend the migrants’ rights to “feel comfortable in Costa Rica,” Badilla said.
This development follows legal action by human rights lawyers who sued Costa Rica, alleging the country violated the rights of dozens of minors by detaining them in camps for two months after their deportation from the United States.
Costa Rican authorities deny any rights violations and maintain they are only trying to assist the United States.
